These terms apply to your use of VELMARX, the website at velmarx.com and the VELMARX app. Please read them together with our Privacy Policy, which explains how personal information is handled.
Acceptance of these terms
By creating an account you agree to these terms. If you use VELMARX on behalf of a business, you confirm that you may agree to them for that business. If you don't agree, please don't use VELMARX.
VELMARX is operated by Marko Novaković, an individual based in Serbia (“VELMARX”, “we”, “us”). These terms are an agreement between you and the operator.
What VELMARX is
VELMARX is software that helps nutrition and fitness professionals work with their clients: client management, nutrition and workout plans, food, recipe and exercise libraries, progress tracking, goals, habits, check-ins, messaging, appointments and notifications. Professionals subscribe; clients they invite use VELMARX free of charge.
VELMARX is a tool. The coaching, advice and plans are provided by the professionals who use it, not by VELMARX.
Health and fitness disclaimer
- VELMARX doesn't provide medical advice, diagnosis or treatment, and isn't an emergency service. In an emergency, contact your local emergency number.
- Nutrition and fitness plans in VELMARX are created by professionals or by you. Use them sensibly, and consult a doctor or another qualified professional before major changes to your diet or exercise, especially if you have a health condition, are pregnant, or take medication.
- Nutrition values are estimates calculated from food data; sample foods in the library are approximate. Check important values against trusted sources.
- VELMARX doesn't guarantee any weight, health, performance or other result.
- Professionals remain responsible for their own advice and for meeting the legal and professional duties of their profession. Nothing in VELMARX replaces those duties.
Accounts and security
- Give accurate information when you register and keep it up to date.
- Keep your password confidential and use one you don't use elsewhere. You're responsible for activity on your account unless it results from our failure to protect it.
- Tell us promptly at info@velmarx.com if you think someone else has accessed your account.
- You must be at least 18 years old to create an account.
Professionals and clients
Professionals can invite clients, create plans and templates, review check-ins, assign goals and habits, message and book appointments with connected clients. A professional must:
- only invite people who agreed to be invited, and only use client information for the services they provide to that client;
- give clients any information about how their data is used that the professional is legally required to give;
- have the qualifications, registrations and insurance their profession requires where they work;
- keep client information confidential and not export or reuse it beyond what the law allows.
Clients join through a professional's invitation, can be connected to more than one professional, choose what progress, goals and habits each professional can see, and can end a connection.
Processing client data for professionals
When a professional uses VELMARX to manage information about their clients, the professional decides why and how that information is used (acts as controller), and VELMARX processes it on the professional's behalf (acts as processor). These data processing terms apply to that information and form part of these terms. VELMARX will:
- process the information only to provide VELMARX to the professional and their clients, following the professional's documented instructions given through their use of VELMARX and these terms, unless the law requires otherwise;
- ensure that anyone authorised to process it is bound by confidentiality;
- protect it with appropriate technical and organisational measures, as described in the Privacy Policy;
- use the service providers listed in the Privacy Policy as sub-processors, under data protection terms, and tell professionals about intended changes to that list so they can object;
- help the professional, as far as reasonably possible, to answer clients' requests to exercise their rights and to meet their own security and data protection obligations;
- tell the professional without undue delay after becoming aware of a personal data breach affecting their clients' information;
- at the end of the service, delete the information or make it available for export, unless the law requires it to be kept;
- make available the information reasonably needed to show compliance with these obligations.
The professional is responsible for having a lawful basis for the information they record about clients and for informing their clients. Information that clients enter themselves with their explicit consent is handled as described in the Privacy Policy.
Acceptable use
You must not:
- break the law, infringe others' rights, or upload content you don't have the right to use;
- harass, threaten or deceive anyone, or impersonate a person or a qualification you don't hold;
- access accounts or data that aren't yours, or test, probe or bypass VELMARX's security;
- upload malware, overload the service, or scrape or copy it with automated tools;
- resell or provide VELMARX to others as a service without our written permission;
- use VELMARX for emergencies or situations where failure could cause serious harm.
Your content
You keep ownership of the information and content you put into VELMARX, such as plans, recipes, photos, messages and progress records. You give VELMARX permission to store, process, display and transmit that content only as needed to run the service for you and the people you share it with, and to keep backups. This permission ends when the content is deleted, except for copies we must keep by law and backups that expire on their normal schedule.
You're responsible for the content you add and for having the right to share it, including photos and information about others.
Our platform and brand
The VELMARX software, design, name and logo belong to the operator of VELMARX or its licensors. These terms give you a personal, non-exclusive right to use VELMARX while your account is active. They don't transfer any ownership. Feedback you send may be used to improve VELMARX without obligation to you.
Plans, trials and pricing
- Free plan: every professional without a paid subscription is on the Free plan, which includes up to 3 active clients and the core tools listed on the pricing page.
- Paid plans (currently Pro and Business) differ by the number of active clients and the tools included. Current prices, billing intervals (monthly or annual) and what each plan includes are shown on the pricing page and at checkout before you pay.
- Free trial: each professional can start one free trial of the Pro plan for the number of days shown in the app (14 days at the time of writing), without payment details. When it ends you move to the Free plan unless you subscribe; nothing is charged automatically.
- Active and paused client connections count toward a plan's client limit. If you're above a limit, for example after downgrading, nobody is disconnected, but you can't add clients until you're within it.
- Clients never pay for VELMARX.
- We may change prices for future billing periods. We'll tell you in advance, and you can cancel before the change applies to you.
Billing, renewal and payment processing
- Subscriptions are sold by Paddle, our merchant of record. Paddle is the seller of your subscription: it runs the checkout, takes your payment, handles sales tax and issues your invoices, and your purchase is subject to Paddle's Buyer Terms. VELMARX provides the service you subscribe to.
- Payment details are entered in Paddle's checkout; VELMARX doesn't receive full card details.
- Subscriptions renew automatically at the end of each monthly or annual period, and the price shown at checkout is charged each period, until you cancel.
- Prices are charged in the currency shown at checkout. Taxes may be added depending on where you are.
- Your plan in VELMARX changes only after Paddle confirms the payment or subscription change to our server. A successful-looking page in your browser alone doesn't change your plan.
- If a renewal payment fails, Paddle retries it and your access continues during that time. If the payment isn't recovered, the subscription ends and you move to the Free plan.
Changes, cancellation and expiry
- You can change plans in Billing. Upgrades and downgrades take effect immediately, and the price difference is calculated pro rata for the rest of the billing period.
- You can cancel in Billing at any time: either at the end of the current period, keeping access until then, or immediately, which ends paid access straight away. A cancellation scheduled for the end of the period can be undone before it takes effect.
- Cancelling doesn't delete your account or data; you move to the Free plan. Immediate cancellation doesn't by itself trigger a refund.
- Payment methods and invoices can be managed in Paddle's billing portal, linked from Billing.
Refunds and consumer rights
Subscription payments are non-refundable, except where a refund is required by applicable law or the applicable payment provider's terms. Cancelling stops future renewals but doesn't by itself entitle you to a refund for the current billing period. The full Refund Policy is part of these terms.
Refund requests can be sent to info@velmarx.com. If you're a consumer, you keep all rights that the law where you live gives you and that can't be waived, including any right to withdraw from a purchase. Nothing in these terms limits those rights. Paddle's Buyer Terms also describe how refunds and chargebacks are handled.
Suspension and termination
- You can stop using VELMARX at any time, and ask us to delete your account (see “Your data after you leave”).
- We may suspend or close an account that seriously or repeatedly breaks these terms, puts others or the service at risk, or where the law requires it. Where reasonable, we'll warn you first and give you a chance to fix the problem or export your data.
- If we stop offering VELMARX, we'll give reasonable notice so you can export your data.
Your data after you leave
- You can download a copy of your information at any time in Settings → Privacy & data.
- Account deletion is handled on request from the same page or at info@velmarx.com. Before deleting, we cancel any paid subscription and consider connected clients or professionals, so information they need isn't removed without notice.
- Some records, such as billing and tax records, may need to be kept for a period required by law.
Details are in the Privacy Policy.
Third-party services
VELMARX relies on other providers to run, including hosting, database and authentication, email and payments; they're listed in the Privacy Policy. Links and images from other websites (for example a recipe photo link) are their owners' responsibility.
Availability and changes
We work to keep VELMARX available and reliable but can't promise it will always be uninterrupted or error-free. Maintenance, updates and problems at our providers can cause interruptions. We may add, change or remove features; if a change significantly reduces what a paid plan includes, we'll tell you in advance.
Disclaimers and liability
To the extent the law allows, VELMARX is provided “as is”. We're not liable for indirect or consequential losses, or for advice, plans or decisions made by professionals or users. Where the law allows us to limit our liability, our total liability for all claims is limited to the amount you paid for VELMARX in the 12 months before the event giving rise to the claim.
Nothing in these terms limits liability that can't be limited by law, such as for death or personal injury caused by negligence, fraud, or your mandatory rights as a consumer.
Disputes and governing law
If you have a problem with VELMARX, please contact info@velmarx.com first; most issues can be solved quickly.
These terms are governed by the laws of the Republic of Serbia, and disputes are decided by the competent court in Belgrade, Serbia. If you're a consumer, you keep the protection of the mandatory laws of the country where you live and may bring proceedings in the courts there where the law allows.
Changes to these terms
We may update these terms when VELMARX or the law changes. For significant changes we'll tell you in the app or by email before they take effect and ask you to accept the new version. If you don't agree, you can stop using VELMARX and cancel your subscription before the change applies.
